Terms of Service

1. Acceptance of Terms
By creating an account, purchasing credits, or using any service offered by 7 Color Box LLP (“7 Color Box”, “we”, “us”, or “our”), you (“Client”, “you”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.
These Terms constitute a legally binding agreement under the Indian Contract Act, 1872. If you represent a company, you warrant that you have the authority to bind that company to these Terms.
We reserve the right to modify these Terms at any time. Continued use of the platform after changes are published constitutes acceptance. Material changes will be communicated by email with at least 14 days’ notice.
2. Description of Services
7 Color Box operates a credit-based digital agency retainer platform offering web development, graphic design, and digital marketing services (“Services”). You access Services by:
- Purchasing a subscription bundle (monthly credit allocation), or
- Purchasing credits individually (top-up).
Each service has a defined credit cost, delivery SLA, and revision limit, listed on the Services page and within the client portal. We reserve the right to change credit costs for new task submissions; changes do not affect tasks already in escrow.
3. The Credit System
Credits are the unit of exchange on 7 Color Box’s platform. One (1) credit is currently priced at ₹150 (inclusive of all applicable taxes).
3.1 Credit Purchases
- Credits are purchased in advance. Payment is processed by Razorpay.
- All credit purchases are final and non-refundable. Credits have no cash value and cannot be redeemed for money. See our Refund Policy for the full policy.
- Credits do not expire while your account is in good standing.
3.2 Credit Escrow
When you submit a task, its credit cost is immediately debited from your balance and held in escrow. This lockout ensures commitment from both parties. Escrowed credits are:
- Released back to your wallet if a task is cancelled before work begins (see §5.3).
- Consumed permanently upon task completion or force-completion.
- Not refundable as cash under any circumstance.
3.3 File Retrieval Credits
Delivered files are available for free download for 15 days after delivery. After that, files are archived. Retrieving an archived file costs 1 credit, which initiates a retrieval within 48 hours.
4. Task Submission and Project Execution
4.1 Brief Requirements (Zero-State Brief Policy)
A task will not enter the active production queue until a complete brief has been submitted. The SLA delivery countdown begins only after your brief is 100% complete and has been reviewed by a Project Manager. Incomplete briefs may be returned for revision at our discretion.
4.2 Service Level Agreement (SLA)
Each service has a stated delivery timeframe (e.g. 5 business days). SLA timers run on Indian Standard Time (IST) business days (Monday to Saturday, excluding Indian public holidays). SLA violations entitle you to a credit compensation as per the SLA breach schedule published on the Services page; they do not entitle you to a cash refund.
4.3 Revisions
Each service includes a stated number of free revisions. Revisions must be requested within the task’s review window via the client portal. Once a task is approved by the client, no further revisions are available under the same task submission. Requesting additional revisions beyond the included limit requires a new task submission and corresponding credit deduction.
4.4 Approval and Force-Completion
Upon delivery, you have 72 hours to review and either approve the deliverable or request a revision. If no action is taken within 72 hours, the task may be automatically marked as “force-completed” and escrowed credits will be consumed. Force-completion may also be applied at the sole discretion of our Project Manager after reasonable notice.
5. Cancellations
5.1 Cancellation Before Work Begins
If you cancel a task while it is still in Pending Brief or Queued status (before the SLA timer has started), the escrowed credits are returned to your credit wallet in full. No cash refund is issued.
5.2 Cancellation After Work Has Begun
Once a task moves to In Progress status, cancellation is not available through the self-service portal. You may contact us at contact@7colorbox.com to request a cancellation review. Partial credit returns (at our sole discretion) may be issued based on work completed at the time of cancellation. No cash refund is issued under any circumstance.
5.3 Account Closure
On account closure, any remaining credit balance is forfeited. Credits hold no cash value and will not be refunded. We recommend exhausting your credit balance before closing your account.
6. PM Override Authority
7 Color Box operates under a Project Manager (PM) Override governance model. Our designated Project Manager (currently: Dhananjay) holds the authority to:
- Force-complete any task after proper notice has been given.
- Reject or modify a brief that is incomplete, contradictory, or undeliverable.
- Apply a discretionary credit adjustment (bonus or deduction) resulting from documented SLA breach or scope creep.
- Suspend an account found to be abusing the revision policy or submitting malicious or fraudulent content.
PM Override decisions are final but may be formally disputed by emailing contact@7colorbox.com within 7 days of the decision.
7. Intellectual Property
7.1 Ownership of Deliverables
Upon full consumption of the task’s escrowed credits (i.e., task is marked completed) and receipt of any outstanding payments, 7 Color Box assigns to you full ownership of the final deliverable files, including all associated intellectual property rights, except as noted in §7.2.
7.2 Portfolio Rights
Unless you explicitly opt out in writing before task submission, 7 Color Box retains a non-exclusive, perpetual licence to display completed deliverables in our portfolio, marketing materials, and social media, with attribution to your company name. To opt out, include a note in your task brief or email us before the task begins.
7.3 Your Content
You warrant that all content, files, and references you provide (brand assets, images, copy) are either owned by you or you have the right to use them. You indemnify 7 Color Box against any third-party IP infringement claim arising from client-supplied material.
8. Warranties and Liability
8.1 Quality Warranty
We warrant that all deliverables will substantially conform to the approved brief. If a deliverable does not meet the agreed specifications, we will revise it at no additional credit cost within the revision allowance. This is your exclusive remedy for quality issues.
A post-delivery 14-day bug/error correction warranty applies to web development tasks: minor technical errors (bugs, broken links, layout issues on agreed browsers) reported within this window will be corrected free of charge. This warranty does not cover new feature requests or changes in scope.
8.2 Limitation of Liability
To the maximum extent permitted by applicable Indian law, 7 Color Box’s total aggregate liability to you under or in connection with these Terms shall not exceed the total credits purchased (valued at ₹150 per credit) by you in the 3 months preceding the claim. We are not liable for:
- Loss of profits, revenue, data, or business opportunities.
- Indirect, consequential, or special damages.
- Third-party actions, downtime of third-party services (Supabase, Razorpay, etc.).
8.3 Disclaimer of Warranties
Services are provided “as is” and “as available”. We disclaim all warranties not expressly stated in these Terms, to the extent permitted by law.
9. Prohibited Conduct
You must not use our platform to:
- Submit tasks involving illegal, defamatory, obscene, or harmful content.
- Infringe third-party intellectual property rights.
- Attempt to circumvent the credit escrow system through chargebacks or fraudulent payment disputes.
- Share your account credentials with any other person or entity.
- Automatically scrape, crawl, or copy platform content.
- Engage in any activity that disrupts platform availability or security.
We reserve the right to suspend or permanently terminate accounts that violate this section, without prior notice and without any refund or credit return.
10. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Noida, Uttar Pradesh. The language of arbitration shall be English.
For disputes below ₹20,000 in value, either party may elect to use India’s online consumer dispute resolution mechanisms under the Consumer Protection Act, 2019.
